Terms of Service

These Terms of Service ("Terms") are the agreement between FinalWork ("FinalWork", "we") and you ("user") for the FinalWork app and its browser version. By creating an account or using the app you accept these Terms and the Privacy Policy.

1. The service

FinalWork is a workforce management app where employers create a workspace and add employees, employees start and end shifts, breaks and tasks are recorded, reports are produced and optional notifications are sent. The service is provided "as is"; we do not promise it will be uninterrupted or error-free.

2. Accounts

• Owners create their own account; they must be at least 18 and provide accurate details.
• Employee accounts are created by the employer, who hands over the sign-in details. Employees accept that the account is managed by the employer.
• You are responsible for keeping your password secret and for everything done with your account. Report unauthorised use immediately.
• Usernames are unique across the platform; misleading names are not allowed.

3. Employer obligations

• The employer is the data controller for their employees' personal data; informing employees and obtaining any required consent is the employer's responsibility.
• Location tracking may only be used in line with applicable labour and data protection law, with employees informed.
• Shift records do not replace statutory payroll or official records; their accuracy depends on the employee's actions.

4. Acceptable use

The following are prohibited:

• Using the service unlawfully or in a way that violates others' rights
• Attempting to access another account, unauthorised access, reverse engineering or automated bulk requests
• Creating fake accounts, providing misleading information, distributing malware
• Abusing the support channel or harassing other users

We may suspend or close accounts that break these rules.

5. Free plan and Premium subscription

• Core features are free. The free plan has limits (such as the number of users and workspaces) and shows ads; current limits are shown in the app.
• Premium is bought as a monthly or yearly subscription through the App Store or Google Play. The price is shown in the store and in the app at purchase time and may vary by country and currency.
• The subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period, and the fee is charged to your store account.
• Cancellation and management happen in your App Store or Google Play account settings; cancellation takes effect at the end of the current period and no refund is issued for that period. Refunds follow the stores' own rules.
• Premium is tied to the owner and applies to all workspaces they own.
• We may change prices and plan contents; existing subscriptions continue on the old terms until the next renewal.

6. Advertising

Third-party ads may be shown on the free plan. Advertisers are responsible for ad content. Premium shows no ads.

7. Intellectual property

The app, design, brand and software belong to FinalWork. You receive a non-transferable, non-exclusive licence for personal or internal business use only. The data you enter belongs to you (employee data to the employer); you allow us to process it to the extent needed to provide the service.

8. Changes and termination

• We may improve the service, add or remove features, or discontinue it with reasonable notice.
• You can delete your account at any time in the app (see "Account deletion" in the Privacy Policy). Deletion cannot be undone.
• We may suspend or delete accounts that violate these Terms.

9. Limitation of liability

To the extent permitted by law the service is provided without warranties. We are not liable for shift or report records being treated as sole evidence in payroll, wage or legal disputes, for data loss, lost profits or indirect damages. Our total liability is limited to the amount you paid FinalWork in the 12 months before the event giving rise to the claim. Mandatory consumer rights are unaffected.

10. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. The Istanbul (Anatolian) Courts and Enforcement Offices have jurisdiction. If you act as a consumer, your right to apply to the consumer arbitration board and courts at your place of residence is preserved.

11. Changes to the Terms

We may update these Terms. Significant changes are announced in the app or by email; continuing to use the service after a change means you accept the new Terms.
